Welcome to Fondamia. This website and online store are operated by CMOON PTE. LTD. under the Fondamia brand. The terms “we,” “us,” and “our” refer to CMOON PTE. LTD.
Fondamia operates this website and store, including all related information, content, features, tools, products, and services, to provide customers with a personalized shopping experience (collectively, the “Services”). Our store is hosted by Shopify, which provides the e-commerce platform that enables us to offer the Services to you.
These Terms of Service, together with any policies referenced in them, describe your rights and responsibilities when you access or use the Services.
Please read these Terms carefully. They contain important information about your legal rights, including warranty disclaimers and limitations of liability.
By visiting, interacting with, purchasing from, or otherwise using the Services, you agree to these Terms of Service and our Privacy Policy. If you do not agree, you should not access or use the Services.
Nothing in these Terms limits any rights that cannot lawfully be limited or excluded under applicable consumer protection laws.
Section 1 — Access and Accounts
By using the Services, you represent that you are at least the age of majority in your state, province, or country of residence.
If you allow a minor dependent to use the Services through a device or account that you own or control, you are responsible for their use of the Services.
You may be asked to provide information such as your email address, billing information, payment information, and shipping address. You represent that all information you provide is accurate, current, and complete and that you have the right to provide it.
You are responsible for maintaining the confidentiality of your account credentials and for activity conducted through your account. You may not sell, transfer, assign, or license your account to another person.
Section 2 — Products and Customer Content
We make reasonable efforts to display and describe our products accurately. However, colors and appearance may vary slightly because of screen settings, materials, lighting, printing processes, and the handmade nature of certain products.
Minor variations that do not materially change the product or an approved design are not considered defects. This does not affect your rights if an item is damaged, defective, or materially different from its description.
Product descriptions, availability, prices, and designs may change without notice. We may discontinue a product or limit the quantities offered to a person, household, geographic region, or jurisdiction.
Photos and Personalization Content
To create a personalized product, you may upload photographs, names, dates, text, or other content (“Customer Content”).
By submitting Customer Content, you represent that:

You own the content or have permission to use it.

Our use of the content to create your order will not violate another person’s copyright, trademark, privacy, publicity, or other rights.

The content is not unlawful, abusive, obscene, misleading, or otherwise inappropriate.
You grant us a non-exclusive, royalty-free license to store, reproduce, adjust, and share Customer Content with our service providers only as reasonably necessary to design, produce, fulfill, deliver, and support your order.
We will not use a privately submitted pet photo for advertising or unrelated marketing without separate permission from you.
We may reject Customer Content or cancel an order if we reasonably believe the submitted content violates these Terms or the rights of another person. If we cancel an order for this reason before production, we will refund any eligible amount paid in accordance with applicable law.
Section 3 — Orders and Personalization
When you place an order, you are offering to purchase the selected products under these Terms. We reserve the right to accept or decline an order for legitimate reasons, including product availability, suspected fraud, payment issues, pricing errors, prohibited Customer Content, or delivery restrictions.
Receiving an automated order confirmation does not prevent us from canceling an order where reasonably necessary. If we cancel an order after payment has been collected, we will notify you and issue the applicable refund.

Cancellation and change requests must be submitted within 24 hours of placing the order. Requests received after 24 hours are not guaranteed because design or production may already have started.

Design Proofs
Some products may include a design proof.
When a proof is provided, you are responsible for reviewing the design, spelling, dates, layout, and other personalization details before approval. Production begins after the proof is approved.
Requests for revisions, replacement photos, or additional information may extend production and delivery times. Once a proof has been approved and production has begun, further changes may not be possible.
Unless otherwise agreed in writing, purchases are for personal or household use and not for commercial resale or export.
Section 4 — Prices, Payment, and Charges
Prices, discounts, and promotions may change without notice. The price charged will be the price shown at checkout when the order is placed, subject to correction of genuine errors.
Unless otherwise stated, displayed prices do not include applicable taxes or shipping charges. Any applicable taxes and shipping charges will be displayed at checkout.
For orders shipped within the United States, applicable customs and import charges are included in the amount paid at checkout. Customers will not be charged additional customs duties upon delivery.
For destinations outside the United States, please contact hello@fondamia.com before placing an order to confirm shipping availability, costs, duties, and estimated delivery times.
Promotions may be subject to separate terms. If promotional terms conflict with these Terms, the specific promotional terms will apply to that promotion.
You agree to provide current, complete, and accurate billing, payment, and account information. You represent that you are authorized to use the payment method provided and agree to pay all charges displayed and accepted at checkout.
Section 5 — Shipping and Delivery
Production and delivery estimates are provided in our Shipping & Delivery Policy.
All delivery dates are estimates unless we expressly state that a delivery date is guaranteed. Delivery may be affected by carrier disruptions, customs processing, severe weather, peak-season volume, incorrect address information, remote delivery locations, or other circumstances outside our reasonable control.
If we cannot ship your order within the promised timeframe, we will notify you and provide any options required by applicable law, which may include accepting a revised shipment date or canceling the affected order for a refund.
Title to and risk of loss for a product pass to you when the product is delivered to the shipping address provided with your order, except where applicable law provides otherwise.
You are responsible for providing an accurate and complete delivery address. If an address needs to be changed, contact hello@fondamia.com as soon as possible. Address changes cannot be guaranteed once an order has been processed for shipping.
Section 6 — Returns, Refunds, and Cancellations
Because Fondamia products are personalized and made to order, they are generally final sale and cannot be returned or exchanged due to a change of mind.
Exceptions may apply if an item arrives damaged, defective, or materially different from what you ordered because of an error on our part.
All return, replacement, cancellation, and refund requests are governed by our Return & Refund Policy and applicable consumer protection laws.
Section 7 — Intellectual Property
The Services and their contents—including trademarks, brand names, logos, text, graphics, product designs, website layouts, photographs, video, audio, and other materials—are owned by or licensed to CMOON PTE. LTD. and are protected by applicable intellectual property laws.
These Terms permit you to use the Services for personal and non-commercial purposes only.
Without our prior written permission, you may not reproduce, distribute, modify, create derivative works from, publicly display, publicly perform, republish, download, store, sell, or commercially exploit material from the Services, except as permitted by law.
The purchase of a personalized physical product transfers ownership of that physical item to you. It does not transfer copyright, trademark, design, or other intellectual property rights in Fondamia’s artwork, templates, product designs, or branding unless expressly agreed in writing.
We do not claim ownership of the original pet photographs you submit. Our permitted use of those photographs is described in Section 2.
“Fondamia” and related names, logos, designs, and slogans are trademarks or brand assets belonging to or licensed by CMOON PTE. LTD. Shopify’s names, logos, products, and services are owned by Shopify or its licensors.
Section 8 — Optional Tools
We may provide access to tools or services offered by third parties. We do not necessarily monitor or control those tools.
Third-party tools are provided on an “as is” and “as available” basis, subject to the third party’s terms. Your use of optional tools is at your discretion and risk.
We may introduce new features, tools, or resources through the Services. Unless otherwise stated, those features will also be governed by these Terms.
Section 9 — Third-Party Links
The Services may contain links to websites, services, or content operated by third parties.
We are not responsible for reviewing or guaranteeing the accuracy, availability, security, or practices of third-party websites. If you leave our Services to access a third-party site, you do so at your own discretion.
Please review the third party’s terms and privacy practices before completing a transaction. Questions or complaints regarding a third-party product or service should be directed to that third party.
Section 10 — Relationship With Shopify
Our store is hosted by Shopify, which enables us to provide the Services.
Purchases made through the Fondamia store are transactions directly between you and CMOON PTE. LTD., not Shopify.
To the fullest extent permitted by law, Shopify and its affiliates are not responsible for the products sold by Fondamia or for claims arising directly from a transaction between you and Fondamia.
Section 11 — Privacy
Personal information collected through the Services is handled in accordance with our Privacy Policy.
Because our store is hosted by Shopify, Shopify may collect and process certain personal information relating to your access to and use of the Services. Certain information may also be processed under Shopify’s Privacy Policy.
Information may be processed by Shopify and other service providers in countries outside your place of residence where necessary to operate the store, process payment, create products, fulfill orders, provide customer support, prevent fraud, and comply with legal obligations.
Section 12 — Feedback and Reviews
If you voluntarily submit a review, suggestion, idea, comment, or other feedback (“Feedback”), you grant us a non-exclusive, worldwide, royalty-free, sublicensable license to use, reproduce, publish, adapt, translate, distribute, and display that Feedback for purposes including operating, improving, and promoting the Services.
If you voluntarily include a pet photo or image of your completed product in a public review, the license applies to the content you chose to submit publicly. We will not use private order-upload photos for marketing without separate permission.
You represent that:

Your Feedback is truthful and does not knowingly mislead others.

You have disclosed any compensation or incentive associated with the Feedback.

Your Feedback does not violate another person’s rights or applicable law.
We may moderate or remove Feedback that is unlawful, abusive, obscene, fraudulent, infringing, or otherwise violates these Terms.
We are not required to keep Feedback confidential, pay compensation for it, or respond to it unless separately agreed in writing.
Section 13 — Errors, Inaccuracies, and Omissions
Occasionally, information on the Services may contain typographical errors, inaccuracies, or omissions relating to product descriptions, prices, promotions, shipping charges, delivery estimates, or availability.
We may correct errors and update information without prior notice. If a material correction affects an order you have already placed, we will notify you and provide an appropriate option, which may include accepting the correction or canceling the affected order for a refund.

You may use the Services only for lawful purposes.
You must not use the Services to:

An automated agent must not conceal that it is automated, mimic a human to bypass protective measures, circumvent a CAPTCHA, or ignore a request to stop accessing the Services.
We may suspend or terminate access when we reasonably believe these Terms have been violated.
Section 15 — Termination
We may suspend or terminate your access to all or part of the Services if you materially violate these Terms, misuse the Services, engage in suspected fraud, or create a security or legal risk.
Termination does not affect any rights or obligations that arose before termination, including outstanding payment obligations.
Sections that by their nature should survive termination—including Intellectual Property, Feedback, Disclaimer of Warranties, Limitation of Liability, Indemnification, Severability, Governing Law, and Privacy—will remain in effect.
Section 16 — Disclaimer of Warranties
To the fullest extent permitted by law, the website, online features, and related Services are provided on an “as is” and “as available” basis.
We do not guarantee that the website will always be uninterrupted, timely, secure, or free from technical errors.
Products purchased through the Services remain subject to their descriptions, our published policies, any express commitments we make, and your statutory consumer rights.
Nothing in these Terms excludes warranties, guarantees, remedies, or other rights that cannot lawfully be excluded.
Section 17 — Limitation of Liability
To the fullest extent permitted by law, CMOON PTE. LTD., its directors, officers, employees, affiliates, agents, contractors, service providers, and licensors will not be liable for indirect, incidental, special, punitive, or consequential damages, including lost profits, lost revenue, lost savings, or loss of data arising from your use of the Services.
To the fullest extent permitted by law, our total liability relating to a product or transaction will not exceed the amount you paid for the product or transaction giving rise to the claim.
Nothing in these Terms excludes or limits liability for fraud, fraudulent misrepresentation, willful misconduct, death or personal injury caused by negligence where such liability cannot be excluded, or any other liability that applicable law does not permit us to exclude or limit.

To the extent permitted by law, you agree to indemnify and hold harmless CMOON PTE. LTD., Shopify, and their respective affiliates, directors, officers, employees, contractors, agents, licensors, and service providers from third-party claims, liabilities, damages, and reasonable costs arising directly from:

The remaining provisions will continue in full force and effect.
Section 20 — Waiver and Entire Agreement
Our failure to exercise or enforce a right under these Terms does not waive that right.
These Terms, together with the policies and operating rules posted on the Services, constitute the entire agreement between you and us regarding your use of the Services and supersede prior communications or agreements relating to the same subject matter.
Any ambiguity in these Terms will be interpreted fairly and in accordance with applicable law.
Section 21 — Assignment
You may not assign or transfer your rights or obligations under these Terms without our prior written consent.
We may assign or transfer our rights and obligations in connection with a merger, acquisition, corporate reorganization, sale of assets, or other legitimate business transfer, subject to applicable law.
Section 22 — Governing Law
These Terms of Service and any separate agreements through which we provide the Services are governed by and construed in accordance with the laws of Singapore, without regard to conflict-of-law principles.
Subject to any mandatory consumer protection laws that apply to you, you and CMOON PTE. LTD. submit to the non-exclusive jurisdiction of the courts of Singapore.

Section headings are included for convenience only and do not limit or affect the interpretation of these Terms.

We may update these Terms from time to time by publishing a revised version on the website. Where required by law, we will provide notice of material changes.
Changes take effect on the date stated in the updated Terms and do not retroactively alter the terms applicable to an order already accepted unless required by law or agreed with you.
Your continued use of the Services after updated Terms take effect constitutes acceptance of those changes.
